THE JUDICIAL REVIEW was heard over 1½ days at the Royal Courts of Justice on Thursday and Friday 13 and 14 November.

It was announced on Friday 28 November that the court decided against the Society. The court held that one person – the City’s dam engineer – can set the standard of safety required. He has chosen a measure of “absolute safety”, against “relative safety”, which applies in many other walks of life including the nuclear industry. The Society is considering an appeal. Subject to planning approval from Camden, the expensive and disfiguring planned works, designed to withstand a rainfall occurrence that might occur once every 400,000 years, can go ahead.
